Italy Fines Apple €98.6 Million Over ATT Rules Limiting App Store Competition

Apple has been fined €98.6 million ($116 million) by Italy's antitrust authority after finding that the company's App Tracking Transparency (ATT) privacy framework restricted App Store competition. The Italian Competition Authority (Autorità Garante della Concorrenza e del Mercato, or AGCM) said the company's "absolute dominant position" in app distribution allowed it to "unilaterally impose" the ATT rules on third-party app developers, without consulting with them beforehand. The investigation was launched in May 2023. The AGCM said it's not calling into question Apple's decision to adopt safeguards designed to enhance users' privacy on iOS, but rather it's taking issue with the consent requirements that are excessively burdensome for developers and "disproportionate" to the stated objectives of ATT. Meta's decision to offer an ad-free subscription in the European Union (E.U.) has faced a new setback after regulators accused the social media behemoth of breaching the bloc's competition rules by forcing users to choose between seeing ads or paying to avoid them. The European Commission said the company's "pay or consent" advertising model is in contravention of the Digital Markets Act ( DMA ). "This binary choice forces users to consent to the combination of their personal data and fails to provide them a less personalized but equivalent version of Meta's social networks," the Commission said . Google has just lost its biggest regulatory battle! Google has been hit with a record-breaking $2.7 billion (€2.42 billion) fine by the European antitrust officials for unfairly manipulating search results since 2008. After a lengthy seven-year investigation that was launched in 2010 after several rivals complaint, the European Commission on Tuesday imposed this 'biggest even financial penalty' against the internet tech giant for breaking EU competition law. by using its search dominance to distort search-engine results to promote own shopping comparison service at the top of all search results.
