Former CIA Engineer Sentenced to 40 Years for Leaking Classified Documents

A former software engineer with the U.S. Central Intelligence Agency (CIA) has been sentenced to 40 years in prison by the Southern District of New York (SDNY) for transmitting classified documents to WikiLeaks and for possessing child pornographic material. Joshua Adam Schulte, 35, was originally charged in June 2018. He was  found guilty  in July 2022. On September 13, 2023, he was  convicted  on charges of receiving, possessing, and transporting child pornography. In addition to the prison term, Schulte has been sentenced to a lifetime of supervised release. "Schulte's theft is the largest data breach in the history of the CIA, and his transmission of that stolen information to WikiLeaks is one of the largest unauthorized disclosures of classified information in the history of the U.S.," the U.S. Department of Justice (DoJ)  said . Unidentified threat actors have deployed a new backdoor that borrows its features from the U.S. Central Intelligence Agency (CIA)'s  Hive  multi-platform  malware suite , the source code of which was  released  by WikiLeaks in November 2017. "This is the first time we caught a variant of the CIA Hive attack kit in the wild, and we named it  xdr33  based on its embedded Bot-side certificate CN=xdr33," Qihoo Netlab 360's Alex Turing and Hui Wang  said  in a technical write-up published last week. xdr33 is said to be propagated by exploiting an unspecified N-day security vulnerability in F5 appliances. It communicates with a command-and-control (C2) server using SSL with forged Kaspersky certificates. The intent of the backdoor, per the Chinese cybersecurity firm, is to harvest sensitive information and act as a launchpad for subsequent intrusions. Joshua Schulte, a former programmer with the U.S. Central Intelligence Agency (CIA), has been found guilty of leaking a trove of classified hacking tools and exploits dubbed  Vault 7  to WikiLeaks. The 33-year-old engineer had been  charged  in June 2018 with unauthorized disclosure of classified information and theft of classified material. Schulte also  faces  a separate trial on charges related to possession of child pornographic photos and videos, for which he was arrested on August 24, 2017. U.S. Attorney Damian Williams  said  in a statement that Schulte was convicted for "one of the most brazen and damaging acts of espionage in American history," adding his actions had a "devastating effect on our intelligence community by providing critical intelligence to those who wish to do us harm." A British court has rejected the U.S. government's request to extradite Wikileaks founder Julian Assange to the country on charges pertaining to illegally obtaining and sharing classified material related to national security. In a hearing at Westminster Magistrates' Court today, Judge Vanessa Baraitser denied the extradition on the grounds that Assange is a suicide risk and extradition to the U.S. prison system would be oppressive. "I find that the mental condition of Mr. Assange is such that it would be oppressive to extradite him to the United States of America," judge Baraitser  said  in a 132-page ruling. The U.S. government is expected to appeal the decision. The case against Assange centers on WikiLeaks' publication of hundreds of thousands of leaked documents about the Afghanistan and Iraq wars, as well as diplomatic cables, in 2010 and 2011. The United States government has filed a superseding indictment against WikiLeaks founder Julian Assange accusing him of collaborating with computer hackers, including those affiliated with the infamous LulzSec and "Anonymous" hacking groups. The new superseding indictment does not contain any additional charges beyond the prior 18-count indictment filed against Assange in May 2019, but it does "broaden the scope of the conspiracy surrounding alleged computer intrusions with which Assange was previously charged," the DoJ said. A federal judge in New York on Monday declared a mistrial in the case of a former CIA software engineer who was accused of stealing a massive trove of the agency's classified hacking and tools and leaking it to WikiLeaks whistleblower website. While the jury was unable to reach a verdict on eight counts of the theft and transmission of CIA's confidential documents, it did find ex-CIA Joshua Schulte guilty on two counts of contempt of court and making false statements to the FBI investigators. Schulte's lawyers last month asked the court for a mistrial in this case claiming the prosecutors withheld evidence that could exonerate his client during the four-week trial in the Manhattan federal court. Potentially, as a result of this, jurors failed to reach a unanimous agreement on the most severe charges against Schulte after deliberating since last week. The United States Justice Department has unveiled charges against WikiLeaks founder Julian Assange with 17 new counts on the alleged violation of the Espionage Act by publishing classified information through WikiLeaks website. If convicted for all counts, Assange could face a maximum sentence of 175 years in U.S. prison for his "alleged role in one of the largest compromises of classified information in the history of the United States." An activist has just leaked thousands of private messages of an organization that's been known to publishing others' secrets. More than 11,000 direct messages from a Twitter group used by WikiLeaks and around 10 close supporters have been posted online by journalist and activist Emma Best, exposing private chats between 2015 and 2017. The leaked chats have been referenced by American media outlets earlier this year, but for the very first time, all 11,000 messages have been published online, allowing anyone to scroll through and read messages themselves.
